Compliance Corner: Top 5 Questions


Everyone loves a top-five list; they condense useful information into a compact, easy-to-read, package. We’re doing our own countdown of the five most frequent questions the Kyäni Compliance department receives and why they might reach out to the Business Partners.

5. Can I participate in third-party online sales?

Some people might think that selling Kyäni products on third-party sales sites like eBay, Amazon, Facebook, Craigslist, OfferUp, Alibaba, eBid, Kijiji, Lazada, and 11street is an easy way to reach new Customers. With these sellers, the product picture and description you see online may look great, but it doesn’t tell the whole story. Customers will never know if the product purchased is expired, damaged, or opened. It is also extremely unlikely that third-party sellers are using adequate standards to protect the product.

Customers can easily purchase from a Business Partner and then will have access to the benefits of Kyäni resources in warehousing, shipping, and Customer care. 

Please be aware that products purchased outside of the official Kyäni Shop are not eligible for our Money Back Guarantee, nor ensure the freshness and safety that Kyäni offers with products shipped directly from our warehouse. 

To ensure that all Kyäni Customers receive quality products and services, we reach out to sellers on these third party sale sites to remind them of our policies.

4. Are my income claims compliant?

Kyäni offers the opportunity to make some extra money, and that’s exciting! We understand how tempting it is for Business Partners to advertise this opportunity and share all of the incredible stories from Business Partners who have made it into the top ranks. This is where the Compliance Department comes in. We work to help Business Partners advertise a realistic expectation of what the Kyäni opportunity can do for its participants.

Income Claims DOs

  • Do share the Global Income Disclosure Statement (income.kyani.com).
  • Do emphasize that reaching your rank took hard work and dedication.
  • Do state how many hours you spent each week building your Kyäni business.
  • Do share how much experience you have with the direct selling industry.

Income Claims DON’Ts

  • Don’t post copies of commission checks or BackOffice screenshots.
  • Don’t use the word “free” to advertise the Kyäni Car Program.
  • Don’t make lavish or unrealistic lifestyle claims.
  • Don’t offer or imply any guarantee of success by simply following a system.

3. Are my product claims compliant?

Kyäni products are pretty fantastic. They offer amazing product benefits and we want to shout it from the rooftops. But as we all know, supplements are not meant to diagnose, treat, cure, or prevent any disease. So whenever a product claim that exceeds Kyäni’s disclaimer allowances catches our eye, we reach out and ask for changes to be made. We want to help Business Partners tell their stories while still sharing product benefits in a way Customers can reasonably understand with appropriate expectations from the products.

Product Claims DOs

  • Do use claims found in the Product Claims Guidelines for your market.
  • Do recommend that Customers talk to their healthcare provider for ALL healthcare concerns or questions.
  • Do state that Kyäni products are dietary supplements and not medicine or treatment for medical conditions or illnesses.
  • Do share positive personal testimonials that are consistent with approved claims.

Product Claims DON’Ts

  • Don’t claim that our products treat, cure, prevent, or help any medical condition.
  • Don’t state or imply that our products helped address, treat, cure or prevent any disease or other medical condition, or that imply a result that is different from, or goes beyond, our approved marketing claims.
  • Don’t make claims for a product that is not found on Kyäni’s website or in Kyäni marketing materials applicable to your region or market.
  • Don’t use unapproved pictures, celebrity endorsements, literature, videos, or materials to promote the products.

2. Can I use the Kyäni Name in my social media profile?

If the Kyäni name is used on social media, any usernames that have Kyäni in them must contain “Kyänidist,” “Kyäni Distributor,” “Kyäni Independent Business Partner” or “Kyäniteam” in them. Usernames may not have Kyäni by itself, or any Kyäni specific product or trade names such as “Sunrise,” “Sunset,” “Triangle of Health” etc. All images that relate to Kyäni products must come directly from Kyäni Corporate or must be officially approved.

Kyäni U.S. Social Media Platforms:

1. Can I operate in unopened international markets?

Business Partners may only operate in officially opened markets (P&Ps 3.j.3.). If Business Partners violate this policy and/or foreign laws, this can create issues that make it impossible for Kyäni to open the market. Kyäni holds Business Partners personally liable for any unauthorized operations. Please do not use names of unopened countries, territories, or regions to advertise Kyäni on your social media accounts or websites.
