No way! In all seriousness… we get it. Learning the in’s and out’s of the compliance and regulatory worlds isn’t necessarily the highlight of everyone’s day (sorry Kyäni Compliance team! We love you!). At the same time, staying compliant is crucial to your business and to ours. So, we thought we’d spice things up a bit and sprinkle a little fun and competition into the mix with our Compliance Days of Christmas Contest! For the contest, we are asking that you please share with us your compliant Kyäni testimonial in written or image form. All participants will have a chance to win a bundle of Kyäni gear! Our judging criteria for this contest will include: (1) Testimonial must be FULLY compliant (e.g., no references to medical conditions, symptoms, lavish lifestyles) (2) The creativity or inspirational impact of the Testimonial (3) Include the appropriate disclaimer (Disclaimers can be found at the end of the “Social Media Guidelines“) (4) Adherence to these Official Rules Remember: You can use the updated Social Media Guidelines, Product Claims Guidelines, and Income Claims Guidelines as guides to help you achieve a compliant testimonial. Compliance Days of Christmas (Contest Rules) NO PURCHASE NECESSARY AND VOID WHERE PROHIBITED. An actual purchase of Kyäni Products is recommended but not required to enter. Contest open to US Residents only and is VOID WHERE PROHIBITED. HOW TO ENTER: You may only enter electronically by visiting https://www.surveymonkey.com/r/66GSHKV. All information provided by entrants must be complete, true and correct. Submissions to the Contest must be received by December 22, 2020 at 11:59:59 p.m. Mountain Time in order to be eligible; Testimonials received after that date will be deemed ineligible to win. All submitted Testimonials (including Photos & Videos) become the property of Kyäni and will not be acknowledged or returned; Kyäni is not responsible for lost, late, inaccurate, incomplete, damaged, illegible, or misdirected entries. Each testimonial must be submitted on an individual basis (i.e., no team, joint, or corporate entries) and all components of the testimonial (including Photos & Videos) must be the original creation of the submitting participant. Only non-commercial work may be submitted. Testimonials may not contain profanity, nudity, pornographic images, violent images, anti-competition messages, illegal material, or material that violates the rights of third parties. Testimonials may not include confidential information, trade secrets, trademarks or copyrighted material belonging to any person or entity other than the entrant absent a suitable license or permission agreement, proof of which is required. Testimonials containing any forbidden matter or material otherwise deemed by Kyäni to be inappropriate will be disqualified. Online entries will be deemed submitted by the authorized account holder of the email address submitted at time of entry. KYANI COMPLIANCE WINNER SELECTION: Selection by the Kyäni Compliance Team. A panel of judges consisting of Kyäni personnel will select twenty-five (25) Testimonials. Judging criteria include (1) Testimonial must be FULLY compliant (e.g., no references to medical conditions, symptoms, lavish lifestyles), (2) the creativity or inspirational impact of the Testimonial, (3) include the appropriate disclaimer (Disclaimers can be found at the end of the “Social Media Guidelines“), and (4) adherence to these Official Rules. Contest Winners will be announced between Monday, December 21, 2020 and Wednesday, December 23, 2020. TERMS & CONDITIONS GENERAL RULES & LIMITATIONS: By entering a Testimonial with an Image & Video, you represent that: (i) your Testimonial and images are your own original works; and (ii) you own or have the rights to convey any and all right and title in any material submitted as part of your entry into the Contest. By entering, you grant to Kyäni a non-exclusive, worldwide, royalty-free license to edit, publish, promote, republish at any time in the future and otherwise use your Testimonial and Photo along with your name and likeness, in any and all media for any purpose, without further permission, notice or compensation (except where prohibited by law). By participating in the Contest, you agree to release Kyäni and its affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the testimonial, ownership, possession, use, or misuse of any prize. Kyäni is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, in any Contest-related materials, or that may limit prize fulfillment or a participant’s ability to enter the Contest. Kyäni reserves the right to amend these Official Rules and to disqualify permanently from the Contest any person it believes has intentionally violated these Official Rules.
